1. Acceptance of Terms
By accessing and using SnapIT Analytics, you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our service.
2. Eligibility
You must be at least 16 years of age to use SnapIT Analytics. By using this service, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these terms. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization to these terms.
3. Use License
We grant you a limited, non-exclusive, non-transferable, revocable license to use SnapIT Analytics for your personal or business purposes in accordance with these terms.
4. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials
- You must provide accurate and complete information when creating an account
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use
5. Acceptable Use
You agree not to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Transmit malicious code or viruses
- Attempt to gain unauthorized access to our systems
- Use the service for spam or harassment
- Interfere with or disrupt the service
- Send fabricated or falsified analytics data
- Use the service to track users without proper legal basis or consent
6. Payment Terms
- Subscription fees are billed in advance on a recurring basis
- All payments are processed securely through Stripe
- You can cancel your subscription at any time; cancellation takes effect at the end of the current billing period
- We reserve the right to change pricing with 30 days advance notice
7. Refund Policy
We offer a 14-day money-back guarantee for new subscriptions. If you are not satisfied with the service, you may request a full refund within 14 days of your initial subscription purchase by contacting support@snapitsoftware.com.
After the 14-day period, no refunds will be issued for partial subscription periods. You may cancel at any time and continue to use the service until the end of your current billing period.
For EU consumers: This refund policy is in addition to, and does not affect, your statutory rights under the EU Consumer Rights Directive, including any applicable right of withdrawal.
8. Intellectual Property
All content, features, and functionality of SnapIT Analytics are owned by SnapIT Software and are protected by copyright, trademark, and other intellectual property laws.
9. User Content
- You retain ownership of content you create using our service
- You grant us a license to use, store, and display your content solely to provide the service
- You are responsible for your content and must have the right to share it
- We may remove content that violates these terms
10. Termination
We reserve the right to suspend or terminate your account for:
- Violation of these Terms of Service
- Fraudulent or illegal activity
- Non-payment of subscription fees
You may terminate your account at any time from your account settings or by contacting support. Upon termination, your data will be handled in accordance with the Data Retention policy below.
11. Data Retention & Account Lifecycle
SnapIT Analytics retains your analytics data according to your subscription status and account activity:
Active Paid Subscribers:
- Your analytics data is retained for as long as your subscription remains active and in good standing
- You may view data by day, month, or year for the duration of your subscription
- Data retention period corresponds to your plan tier (e.g., Basic: 90 days, Pro: 180 days, Business: 365 days, Enterprise: 730 days, Premium: unlimited)
Subscription Cancellation or Non-Payment:
- If you cancel your paid subscription or your payment method fails, your account reverts to the Free tier at the end of your current billing period
- Under the Free tier, you may view up to 30 days of analytics data at a time
- Historical data beyond the Free tier retention window is archived but not deleted immediately
Inactive Accounts (90 Days):
- If your account has no login activity for 90 consecutive days and you are not on an active paid subscription, your account is classified as inactive
- Inactive accounts are archived; only the most recent 3 months of analytics data remain accessible
- You may reactivate your account at any time by logging in; archived data will be restored to the extent available
Dormant Accounts (180 Days):
- If your account remains inactive for 180 consecutive days with no paid subscription, all analytics data associated with your account will be permanently deleted
- Account credentials and profile information will also be deleted
- This deletion is irreversible; we cannot recover deleted data
- We will send email reminders at 60 days, 90 days, and 150 days of inactivity before deletion occurs
Account Termination by User:
- If you choose to delete your account, all analytics data, tracking configurations, and personal information will be permanently deleted within 30 days
- You may request an export of your data before deletion via the dashboard or by contacting support
Data Export: Paid subscribers may export their analytics data at any time in CSV or JSON format via the dashboard export feature or the API. We recommend exporting your data before downgrading or canceling your subscription.
12. Disclaimer of Warranties
SnapIT Analytics is provided "as is" without warranties of any kind, either express or implied, to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free service.
13. Limitation of Liability
To the fullest extent permitted by applicable law, SnapIT Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim.
14. Indemnification
You agree to indemnify and hold harmless SnapIT Software from any claims, damages, or expenses arising from your use of the service or violation of these terms.
15. Dispute Resolution
Any disputes arising from or relating to these Terms of Service shall be resolved as follows:
- Informal Resolution: We encourage you to contact us first at support@snapitsoftware.com to attempt to resolve any dispute informally.
- Binding Arbitration: If informal resolution is unsuccessful, any dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Travis County, Texas, or remotely at your election.
- Small Claims Court: Either party may bring claims in small claims court if the claims qualify.
- Class Action Waiver: All disputes must be brought in an individual capacity, not as a class action or representative proceeding.
For EU consumers: This dispute resolution clause does not prevent you from bringing proceedings before the courts of your member state of residence, nor does it affect any mandatory consumer protection rights under applicable EU law.
16. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of significant changes via email or a prominent service announcement at least 30 days before the changes take effect. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
17. Governing Law
These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law provisions. For EU consumers, mandatory consumer protection provisions of your country of residence may also apply.
